Terms and Conditions

1. Who we are
These Terms and Conditions (the “Terms”) govern the use of arkans.ca and the services provided by Arkans Corporation, a corporation based in Ontario, Canada, operating publicly as “Arkans” (“Arkans”, “we”, “our”, “us”). By requesting a preview, using this website, or purchasing services, you agree to these Terms.
Arkans designs, builds, hosts, and maintains websites for local service businesses, with a focus on making it easier for customers to call, book, or request a quote.
2. Website previews
Preview requests are free, and no payment is required before viewing a preview. Previews are usually prepared within 72 hours of a request, though timing can vary with volume and the information available.
A preview is a demonstration of proposed work. It remains the property of Arkans Corporation and may be taken offline at any time. Requesting or viewing a preview creates no obligation for either party.
3. Service scope
A paid engagement normally includes:
- Design and build of a website based on the accepted preview.
- Hosting and ongoing maintenance while a plan is active.
- Click-to-call buttons and a quote or booking request form on the website.
- One-way instant lead notifications: when someone submits the website’s form, the details are sent to the contact (such as an email address or phone number) the client has designated.
- Uptime checks, plus form and notification checks.
- Small content edits each month, such as updates to services, hours, prices, or offers.
Lead notifications are delivered through Arkans’ standard internal notification setup, which is included in the service while a plan is active.
4. What is not included
Unless separately agreed in writing, services do not include:
- Paid advertising or ad management.
- Search-ranking guarantees or ongoing SEO campaigns.
- Copywriting beyond the agreed website content.
- Custom backend systems, databases, or software integrations beyond Arkans’ standard website and lead-notification setup described in Section 3.
- Google review or Business Profile management, or any review-request service, as part of the paid package.
- Third-party fees, such as domain registration, booking tools, or premium services chosen by the client.
For eligible clients who start with the first 3 months prepaid, Arkans may offer a Google review request flow as a goodwill bonus. Any such bonus is offered at Arkans’ discretion, is not part of the paid package, and carries no promise of review volume or other results.
5. Client responsibilities
- Provide accurate business information and content, and review the website for accuracy before and after launch — particularly any claims subject to industry or professional rules.
- Provide feedback and approvals within a reasonable time.
- Only supply text, images, logos, and other materials that you have the right to use, and grant Arkans permission to use them to deliver the services.
6. Payments and billing
Payments are processed in Canadian dollars through Stripe. Applicable taxes are added where required. Current founding-client pricing:
- CAD 900 upfront, covering the first 3 months of maintenance.
- CAD 300 per month after the first 3 months.
- Founding setup: CAD 0 with 3 months prepaid, for the first 5 local businesses. The standard setup fee after founding spots is CAD 1,000.
Monthly maintenance is billed as a recurring subscription. If a payment fails or an account is left unpaid, we may pause services, including hosting, after reasonable notice.
7. Third-party services
Delivering the services depends on third-party providers, which have their own terms and availability, including: Stripe (payments), Tally (forms), Vercel (hosting and analytics), Purelymail (email), domain registrars and DNS providers, booking tools, and Google services such as Maps and Business Profiles where applicable. Arkans will make reasonable efforts to work around third-party outages or changes but does not control these providers.
8. Intellectual property
- You keep all rights to the materials you provide, such as your logo, photos, and business content.
- Arkans Corporation retains ownership of its reusable tools, templates, workflows, and internal systems used to build and operate websites.
- Once the required payment for the applicable work has been made, you receive the right to use the delivered website, including its design and content, for your business.
- If you cancel and want to take the website code with you, a one-time CAD 1,000 code buyout applies. After the buyout is paid, Arkans provides the website code. Arkans’ internal lead-notification and backend infrastructure is not included in any code handoff and remains the property of Arkans Corporation.
9. Acceptable use
Websites and services provided by Arkans may not be used for unlawful activity, misleading or infringing content, or content that harms others. We may decline or discontinue work that we reasonably believe falls into these categories.
10. No guaranteed results
Arkans builds practical websites designed to present a business clearly. We do not guarantee specific business outcomes, including numbers of calls, leads, bookings, customers, reviews, search rankings, or revenue.
11. Limitation of liability
To the extent permitted by law, Arkans Corporation’s total liability for any claim connected to the services is limited to the amounts you paid for the services in the 3 months before the event giving rise to the claim. We are not liable for indirect or consequential losses, such as lost profits or lost data. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
12. Termination and cancellation
You can cancel at any time with written notice, and either party may end an engagement with written notice. When you cancel, future payments stop from the next billing cycle, and you keep access to the website and services through the end of the current paid billing period — including the initial prepaid 3-month period — unless there is misuse, nonpayment, or another valid service issue. Sections that by their nature should survive — including payment obligations for work performed, intellectual property, and limitation of liability — survive termination. 13. Changes to these Terms
We may update these Terms from time to time. The current version is always available on this page, with the date above. Continued use of the services after an update means the updated Terms apply.
14. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario.
